Terms & Conditions

By purchasing any product (Software) from magento.modulabs.com you agree to the following (Agreement):

1. Company Spletni sistemi d.o.o. is the copyright holder of the Software. The Software or a portion of it is a copyrightable matter and is liable to protection by the law. Any activity that infringes terms of this Agreement violates copyright law and will be prosecuted according to the current law. We reserve the right to revoke the license of any user who is holding an invalid license.
2. You may not use any part of the code in whole or part in any other software or product or website.
3. You may not give, sell, distribute, sub-license, rent, lease or lend any portion of the Software or Documentation to anyone. You may not place the Software on a server so that it is accessible via a public network such as the Internet for distribution purposes.
4. You are bound to preserve the copyright information intact, this includes the text/link at bottom of templates.
5. We reserve the right to publish a selected list of buyers of our Software.
6. We will not be liable to you for any damages (including any loss of profits/saving, or incidental or consequential) caused to you, your information and your business arising out of the use or inability to use this Software.
7. We are not liable for prosecution arising from use of the Software against law or for any illegal use.
8. If you fail to use the Software in accordance with the terms and conditions of this License Agreement, it constitutes a breach of the agreement, and your license to use the program is revoked.
9. Spletni sistemi d.o.o. reserves the right to change this license agreement at any time and impose its clauses at any given time.
10. License agreement remains effective until terminated. We retain the right to terminate your license to use the Software at any time, if in its sole discretion, you are not abiding by the terms of the Agreement, including, but not limited to, obscuring or removing any link or copyright notice as specified in this agreement. You may terminate it at any time by destroying all copies of the Software. Termination of this Agreement does not bind us to return you the amount spent for purchase of the Software.
11. If you continue to use the Software after Spletni sistemi d.o.o. gives you notice of termination of your license, you hereby agree to accept an injunction to enjoin you from its further use and to pay all costs (including but not limited to reasonable attorney fees) to enforce our revocation of your license and any damages suffered by us because of your misuse of the Software.

Upgrades

We provide our customers with free upgrades of the product they buy, limited to the product version branch. It means, that buying a product version N.x gives right to receive free updates for the version brunch N. (N.x, N.x.x). After an update is available all buyers can download it from "Downloadable products" area when logged in.

Limited Liability

Spletni sistemi d.o.o. is not responsible for the use of websites http://magento.modulabs.com and for any damage caused by the use of its online content and products. Spletni sistemi d.o.o. will always try to publish proper informations. Spletni sistemi d.o.o. can change all content at any time, without obligation to notify the user and is not responsible for the consequences caused by the changes. Spletni sistemi d.o.o. will not be liable for any direct, indirect, incidental, economic or consequential loss in any case arising from the use or misuse of informations and products, even if there was possibility of such damages.

Use of products

Product purchased on magento.modulabs.com can be used only once on a single URL link (except in cases where the product description specifically mentions that it can bind to multiple URL links or when webstore has different languages and each language has its own domain).

The product may be transferred to a new URL address just in case the old URL is no longer in use. If a customer wants to transfer purchased product to a new URL link, must notify Spletni sistemi d.o.o. via e-mail info@spletnisistemi.si and write both URL link - old and new and also add an explanation of why they want to transfer the product. On the basis of received explanation Spletni sistemi d.o.o. decide and notify the customer if the product can be transferred to a new URL or not.

All products include a license which is checked by Spletni sistemi d.o.o. on the user's server (ioncube). In case of stealing license, unauthorized copying of the product at another store or reuse the product at the second URL, Spletni sistemi d.o.o. will charged to violator four times (4 x) the value of regular retail price of the product.

If violator refuse to pay, Spletni sistemi d.o.o. will send an action against the offender in a competent court in Kranj, Slovenia.

Special prices

Special prices and discounts are not applicable to modules which are developed for custom applications!

Email Address

All products are available for download since the payment has been acceepted and verified. If you can't download a product please check status of your payment via payment processor interface. In case of increased sales and high occupancy of our programmers when our extension is not customized yet for each platform, it will take us up to 3 weeks to customized it for certain platform and send you extension files. Because of this special case of waiting refund is not possible.

Refunds

To ensure your protection we offer 15-day money back guarantee for ALL our software products. If you are dissatisfied with your product during 15 days after the purchase for any reason, you can receive a full refund. To request a refund please submit a request containing your Transaction ID. Please note, we do not provide money backs on installation and customization services.
